No decision made in whether to toss confession of mom accused of putting baby in dumpster

The attorney for the 35-year-old woman accused of tossing her baby in a dumpster last year in West Boca wants her client's confession thrown out.

However, a decision wasn't made and the judge is "taking the matter under advisement."

The Palm Beach County Sheriff's Office says Rafaelle Sousa was arrested back in May after her newborn baby girl was found inside a dumpster. Sousa admitted to delivering a baby girl, placing her in a bag, then throwing her in the dumpster. She said she went back twice to make sure the baby was dead, but never approached the bag because there were people in the parking area around the dumpster. The little girl was returned to her father in July.

According to court documents, Sousa's lawyers filed a motion to suppress her statements, claiming her Miranda rights weren't read to her properly due to a language barrier.

Another hearing is scheduled for Feb. 3.
